Understanding Equitable Division
Maryland is an equitable division state. Many people mistake the word equitable for the word equal. In actuality, equitable means fair. In some cases, an equal division of assets is fair. In other cases, however, it may be fair to shift the balance in one direction or another.
Determining what is fair is no simple task. It requires a careful look at a variety of factors, including each spouse’s age, health and earning capacity.
